It seems all President Aquino promises didn`t happened. Specially for those words during SONA that all problem that he is facing right now is only a inheritance "Pamana" from the former Administration. One of those problem that he inherits is the flood problem in Entire Luzon which can affects to the LGU economics and also the studies of the student. In just 1 heavy rain is equivalent to class suspension for all levels.<br />
<br />
Because of the floods problem he spend billions of pesos for the flood control projects and that funds is came from the illegal process with 3 letters only "DAP". According to him this billions project will help to control the volume of water that will overflow in the places affected of the heavy rain.<br />
<br />
Now  who will be blame of this tragedy the government, the society or the former administration. Because we all knew that this is our president hobby poiting others to blame if their`s a problem and save himself. I`m looking forward for his another attack to his fellow politician regarding in this flood problem.<br />

But still the Luzon is lucky this day compare during Ondoy because ondoy traverse at the center of Luzon while Mario is traverse at the edge of Luzon. Unfortunately Mario still gave a hard time to our fellow pilipino`s but the worst thing will happened in this calamity is not only the flood, losing your house or love ones but also the profiteer is also the major problem.<br />

So kung Work Financial Plan palang yan ibig sabihin di pa na implement kasi "PLAN" palang tapos sasabihin niya na 90% ng mga donasyon naibigay na. Panu ka makaka implement kung nag pla-plano ka palang.<br />

Meron din ako naalala na ang WFP o World Food Program ay bumili sa DSWD ng mga relief goods para ipamigay sa mga biktima noong Nov. 9,2013 at iyon ang mga preposition relief goods para sa mga biktima ng bagyo at worth millions of dollar;"ayon sa WFP Philippines.<br />

Kung meron man natanggap ang mga biktima tiyak di umabot ng 50% ang naibigay ng DSWD kasi bininta na nila ang Relief Goods sa WFP"World Food Program" at saan niya naman nakuha ang 90% na yan bakit wala siya statistics na maipakita kung anu-anu yung pinagamitan ng 90% na iyan.<br />

Meron din siya nabangit na Cash for work para sa pag linis ng irrigation canal pero ito ay pawang kasinungalingan o kathang isip lang. Panu kaba mag lilinis ng irrigation canal kung ang mismo mga magsasaka ang nag lilinis nito kung saan hindi DSWD ang nagpapasahod sa kanila.<br />

Pati ung Family Assistance Access Card o Green Card meron din issue ayon sakin nakalap na information na kung dati per family ang mabibigyan ng mga tulong galing sa DSWD or National Government ngayon magiging per household nalang. Panu po naging Family Assistance Access Card iyan kung per household ang basihan dahil alam naman natin na ugali ng mga pilipino na sa isang bahay more than families minsan ang nakatira.<br />

Ito hamon ko kay Sec. Dinky Soliman since sabi mo na mabilis ang tulong ng DSWD bakit po ba di ka pumanta sa Leyte bisitahin mo at sabihin mo sa harap nila mismo ang mga pinagsasabi mo sa Media.<br />

Their are two types of cases that possible to file if you are a corrupt government official first is Plunder second is Malversation of public funds. Now lets define the meaning of those two cases.<br />

<b>Plunder</b> <i>(Non-bailable)</i> - The most discussed law these days is Republic Act 7080 otherwise known as the law on plunder.  Seen as a deterrent to prevent public officials from stealing money from the government, the plunder law was passed in 1991 with  the most significant signatory being one Senator Joseph Estrada. In this edition of the Law Professor, we shall now examine the intricacies of the Plunder Law.<br />
<br />
What is plunder and how is it committed?  According to Section 2 of RA 7080, plunder is committed when a public officer who, by himself or in connivance with members of his family, relatives by affinity or consanguinity, business associates, subordinates or other persons, amasses, accumulates or acquires ill-gotten wealth through a combination or series of overt or criminal acts as described in Section 1 (d) of RA 7080 in the aggregate amount or total value of at least Fifty million pesos (P50,000,000.00). In addition, any person who participated with the said public officer in the  commission of plunder shall likewise be punished.<br />

<b>Marversation of public funds</b> <i>(bailable) </i>- Final point on the crime of malversation: Although the crime of intentional malversation includes malversation committed through negligence, or {rather than neglect of duties}, the crime of technical malversation is not necessarily included in the crime of simple malversation. So if a public officer was charged for simple malversation under Article 217 of the Code, but during the trial, the evidence shows that the missing fund or property was applied to public use, and the crime therefore would be technical malversation, the trial court should then suspend the proceedings, and require the prosecutor to file the proper information for technical malversation. Otherwise, if the trial court will proceed and then render judgment against the accused for technical malversation, the judgment is null and void. The constitutional right of the accused to be informed of the nature and cause of the accusation against him will be violated. This is so because the evidence required for conviction in simple malversation is materially different from the evidence required in technical malversation.<br />

WTF 1Billion DAP goes to 1 Senator Only?

Wow! huge amount of money in one person only. This is really DAP works?, now i know why Drilon is the biggest senator in the Philippines its because he get a huge amount of money. If the allegation is true where did he spend that amount of money?, and during the impeachment of SC Corona he received 100million DAP. The implementing of DAP their is a NEPOTISM maybe that`s the reason why DAP is worst than PDAF. But unfortunately he denied it just like the other allegation against to him.<br />

<b>Leyte Convention Center</b>  - this building is newly built and located in the vicinity of the government center in the town of Palo Leyte. The purpose of this building is to boost tourism and economic development of the region. But unfortunately this building is not durable cannot handle a strong typhoon like super typhoon yolanda(haiyan). This building is worth millions of pesos but why still totally destroyed just like a shanty house. This is not reported in the national tv because its normal to see a building like this in leyte. This building built by Petilla`s Clan to match the Tacloban Convention Center. The`re many substandard building that built by the politician here in the Philippines and Leyte Convention Center is one of those thousands substandard projects. Petilla`s Clan is also known "Kapit Tuko" Clan in Leyte no major allies in politics. Their purpose is to save their image and to keep them in the position. <br />

Before the super typhoon yolanda landfall, this building has been proven that it can handle a strong typhoon. This building used as a temporary shelter for how many months after super typhoon yolanda landfall in Leyte. 1st is <b>Cory Aquino</b> and her allies. Their family is the major beneficiaries of all Government Owned one of those are the <b>Philippine Air Lines</b> or <b>PAL </b>she approved in January 1992 the sale of 67% of the stocks of the 
Philippine Air Lines (PAL) to an investment group headed by her 
relatives, composed of one of her Tanjuatco nephews and three of her 
Cojuangco nephews. The sale resulted in a loss of USD 300-million plus 
for the Filipino people. The Philippine government, through the 
Government Service Insurance System (GSIS), owned the shares. And worse,
 her nephews did not even have the money to pay for the airline stocks. 
They borrowed the money that they used to pay the GSIS from three 
Philippine government-owned banks, even using the PAL stocks as 
collateral. “The PAL Scandal,” where Cory authorized in 1992 the sale of the PAL 
Building in San Francisco, California. It resulted, according to the 
column of the late journalist Louie Beltran, into a USD 6-million loss 
to the national airline. Cory did not charge Mr. Beltran with libel on 
this issue about the PAL Building. She, however, did file a libel case 
against Mr. Beltran and his publisher, Maximo V. Soliven on a separate 
issue, when Beltran wrote that Mrs. Aquino “hid under her bed during a 
coup d’etat attempt at the presidential palace in Manila”. And the assets of the Marcoses, the Romualdezes and their cronies were 
supposed to have been sequestered by the new Aquino administration, but 
Kokoy Romualdez’s (Ferdinand Marcos Sr.’s brother in law) 38 companies, 
which were worth billions of pesos, were not turned over to the 
Presidential Commission on Good Government. Cory instead during her 
first months in office, permitted the transfer of these 38 companies to 
her own brother-in-law, Ricardo “Baby” Lopa. What’s worst, was the fact 
that all 38 companies were bought back by Lopa during the transfer for 
the price of only USD 227,000. The same case happened with the ownership of the Philippine Long 
Distance Company. Instead of sequestering the company for the Philippine
 government (as it was then controlled by the Marcos cronies), she 
returned the billion-dollar company to her Cojuangco nephews. She 
claimed that her nephews were illegally eased out by Mr. Marcos. The 
truth was that the Marcos cronies, whether their money were ill-gotten 
or not, paid the Cojuangcos the prevailing market-stock prices during 
the sale of equity that happened between them at the time when Marcos 
was still president.<br />

The process of <a href="http://en.wikipedia.org/wiki/Constitutional_reform_in_the_Philippines">amending the 1987 constitution of the Philippines</a> is popularly known to many Filipinos as <a href="http://en.wikipedia.org/wiki/Charter_Change">Charter Change</a>. Any proposed amendment or revision to the 1987 Constitution shall only be valid when ratified by the majority of Filipinos in a plebiscite.<br />

An <a href="http://en.wikipedia.org/wiki/Enabling_act">enabling law</a> for the Article XVII, Section 2 Philippine Constitutional provision, called the Initiative and Referendum Act (authored in 1987 by senators <a href="http://en.wikipedia.org/wiki/Raul_Roco">Raul Roco</a> and <a href="http://en.wikipedia.org/wiki/Neptali_Gonzales">Neptali Gonzales</a>), was passed by the <a href="http://en.wikipedia.org/wiki/Eighth_Congress_of_the_Philippines">Eighth Congress of the Philippines</a> in 1989. The law provides for the implementation of the exercise of the people's right to initiate a <a href="http://en.wikipedia.org/wiki/Petition">petition</a> to amend the Constitution, with the Election Registrar of the <a href="http://en.wikipedia.org/wiki/Commission_on_Elections_(Philippines)">Commission on Elections</a> tasked under this law with the verification of the petition signatures' being by at least twelve per centum of the total number of registered voters in the state.<br />

In short, it is the power of the people to propose amendments to the Constitution, or to propose and enact legislation's through an election called for the purpose<br />

<b>Will you sign this P.I</b><b><i>(People Initiative)</i>? - </b>Yes!, i will sign the People Initiative. This is the best way to avoid corruption and to prevent the lump sum founds. For example they cannot release a budget without a proposed project not just like this day.. One of those is the Budget in Bataan which is they already have a estimated costs without a proposed project.<br />

<b>How the People Initiative will pass? - </b>It needs 6 million signature of registered voters every district must have at least 3%. And after they reach 6 millions signature they will forward it to the comelic for signature verification.<br />

<b>Requirements:</b><br />
-There must be a written petition<br />
-The petition must have at least 12% of the total number of registered voters as signatories<br />
-Of the 12% total registered voters, at least every district must be represented by 3% of the registered voters therein<br />

PDAF and DAP has a similarities, like PORK they are both PORK and source of corruption but DAP is worst than PDAF. Because PDAF has a limitation of allocation budget, for example Congressman can allocate PDAF P70 million every year with P30 million for the "soft" project and P40 million for the the "hard" project while the Senators can allocate PDAF P200 million every year with P100 million for "soft" project and another P100 million for "hard" project. But the DAP is different to PDAF because DAP is "Illegal" while PDAF is "Legal" and DAP has no limitation of budget founds, for example if you are close or allies to the administration you will received higher amount like Senate President Drillon received P100 million DAP founds and Sen. Chiz received P99 million while the other Senator like Sen. Jinggoy, Sen. Bong Revilla and others Senator received P50 million but the 3 Senator didn`t received any amount of DAP Sen. Mirriam, Sen. Marcos and Sen. Arroyo.<br />
<br />
<b>How PDAF works?</b> - very simple the legislators submit their list of pork-funded projects to the Department of Budget and Management for processing. Once the DBM approves the projects, the agency issues a special allotment release order (SARO).<br />
<br />
<b>What is SARO? - </b>or Special Allotment Release Order is a document issued by the Department of Budget and Management (DBM). It triggers the release of funds for lump-sum items such as the Priority Development Assistance Fund (PDAF) or pork.<br />
<br />
<b>What is the use of PDAF?</b> - is a <a href="http://en.wikipedia.org/wiki/Discretionary_spending">discretionary fund</a> in the <a href="http://en.wikipedia.org/wiki/Philippines">Philippines</a> available to members of <a href="http://en.wikipedia.org/wiki/Congress_of_the_Philippines">Congress</a>. Originally established as the Countrywide Development Fund (CDF) in 1990, it is designed to allow legislators to fund small-scale infrastructure or community projects which fell outside the scope of the national infrastructure program, which was often restricted to large infrastructure items.<br />
<br />
<b>Legislators can pick from the following projects:</b><br />

<li>Education – e.g. scholarships</li>
<li>Health – e.g. financial assistance to indigent patients, purchase of medical equipment</li>

<b>What is DAP?</b> - The Aquino Administration introduced the Disbursement Acceleration Program (DAP) as a reform intervention to speed-up public spending and to boost economic growth. It is not a fund, but a mechanism to support high-impact and priority programs and projects using savings and unprogrammed funds. DAP also enabled the government to introduce greater speed, efficiency, and effectiveness in budget execution.<br />

<b>How DAP works? -</b> The DAP tapped the power of the president over a) the use of savings to augment deficient programs and projects; and b) the use of unprogrammed funds.<br />
<br />
Savings are available portions or balances of items under the General Appropriations Act (GAA) which result from: a) the completion or final discontinuance or abandonment of a program, activity, or project; b) unpaid compensation for vacant or unfilled positions and leaves of absence without pay; or c) the implementation of efficiency measures that enable agencies to deliver services at lower cost. Such savings may then be used to augment funds for programs, activities, or projects which are included in the GAA (i.e. nonexistent budget items cannot be funded).<br />
<br />
Unprogrammed funds are standby appropriations which are authorized by Congress in the annual GAA, and which may only be used when a) revenue collections exceed revenue targets; b) new revenues are collected from sources not included in the program; or c) newly-approved loans for foreign-assisted projects are secured. Such funds can be used for new programs, activities, or projects as long as these are consistent with the purposes listed in the GAA for the use of unprogrammed funds.<br />
<br />
Previous administrations had used these authorities in the past to address urgencies they faced. Moreover, the Aquino Administration sharpened the application of such powers by prioritizing funding for programs and projects which are a) fast-moving or quick disbursing; b) urgent or priority in terms of social and economic development objectives; and c) performing well and could deliver more services with additional funds.</div>

<b>Why DAP is worst compare to PDAF? </b>- because DAP is the <i>unlimited funds </i>compare to PDAF. With selective beneficiary and threat to the opposition and the balance of power will be lost. Your Loyalty to the administration is equivalent to DAP funds, if you opposed to the administration is equivalent to P0 DAP funds.</div>

In 2000 he declared an "all-out-war" against the <a href="http://en.wikipedia.org/wiki/Moro_Islamic_Liberation_Front">Moro Islamic Liberation Front</a> and captured its headquarters and other camps. However, allegations of <a href="http://en.wikipedia.org/wiki/Corruption">corruption</a> spawned an <a href="http://en.wikipedia.org/wiki/Impeachment">impeachment</a> trial in the Senate, and in 2001 Estrada was ousted by "People Power 2" after the prosecution walked out of the impeachment court when the Senator-Judges voted "no" in the opening of the second envelope. The <a href="http://en.wikipedia.org/wiki/EDSA_2">EDSA 2</a> protests resulted from the concerted efforts of political, business, military, and church elites who were displeased by Estrada's policies that included removal of sovereign guarantees on government contracts. Former First Gentleman Mike Arroyo also admitted in an interview with Nick Joaquin that he and then-Ilocos Sur Gov. <span style="font-family: Verdana, sans-serif; font-size: x-small;">The last quarter of 2000 up to the first week of January 2001 was a period of political and economic uncertainty for the Philippines. On January 16, 2001, the impeachment trial has also taken a new direction. Private prosecutors walked out of the trial when pro-Estrada senators prevented the opening of an evidence (a brown envelope) containing bank records allegedly owned by President Estrada. With the walk out, the impeachment trial was not completed and the Filipinos eventually took to the street to continue the clamor for President Estrada's resignation. From January 17 to 20, 2001, <a href="http://en.wikipedia.org/wiki/2001_EDSA_Revolution">hundreds of thousands</a> of Filipinos gathered at <a href="http://en.wikipedia.org/wiki/Epifanio_de_los_Santos_Avenue">Epifanio de los Santos Avenue</a> (<a href="http://en.wikipedia.org/wiki/EDSA_(road)">EDSA</a>), the site of the original <a href="http://en.wikipedia.org/wiki/People_Power_Revolution">People Power Revolution</a>. The clamor for a change in the presidency gained momentum as various sectors of Philippine society – professionals, students, artists, politicians, leftist and rightist groups – joined what became known as EDSA II. Officials of the administration, the<a href="http://en.wikipedia.org/wiki/Armed_Forces_of_the_Philippines">Armed Forces of the Philippines</a> (AFP), and the <a href="http://en.wikipedia.org/wiki/Philippine_National_Police">Philippine National Police</a> (PNP) also withdrew their support for President Estrada.<br />

Days after leaving <a href="http://en.wikipedia.org/wiki/Malaca%C3%B1ang_Palace">Malacañang Palace</a>, President Estrada's lawyers questioned the legitimacy of Arroyo's presidency before the Supreme Court. He reiterated that he did not resign as president and that at most, Arroyo was just serving in an acting capacity. The high court, however, voted unanimously in upholding the legitimacy of Arroyo's succession. As a consequence, Estrada no longer enjoys immunity from charges being filed against him.<br />

In the last week of April 2001, the Sandiganbayan ordered the arrest of Estrada and his son, Senator <a href="http://en.wikipedia.org/wiki/Jinggoy_Estrada">Jinggoy Estrada</a>, for plunder charges. A few days later, Estrada supporters protested his arrest, gathered at the EDSA Shrine, and staged what they called, <a href="http://en.wikipedia.org/wiki/EDSA_III">EDSA III</a> – comparing their actions to the People Power revolution of 1986 and January 2001.<br />

Thousands of protesters demanded the release of Estrada. Eventually, they also called for the ouster of Arroyo and the reinstatement of the former. On May 1, 2001, they marched towards Malacañang to force Arroyo to give in to their demands. Violence erupted when the protesters attempted to storm the presidential palace and the military and police were forced to use their arms to drive them back. Arroyo declared a state of rebellion because of the violence and prominent political personalities affiliated with Estrada were charged and arrested. The so-called EDSA III was the first serious political challenge to the Arroyo presidency.<br />

Arroyo, who earned a master's degree and doctorate in economics, made the <a href="http://en.wikipedia.org/wiki/Economy_of_the_Philippines">Philippine economy</a> the focus of her presidency. Annual economic growth in the Philippines averaged 4.5% during the Arroyo administration, expanding every quarter of her presidency. This is higher than in the administrations of her three immediate predecessors, <a href="http://en.wikipedia.org/wiki/Corazon_Aquino">Corazon Aquino</a>(3.8%), <a href="http://en.wikipedia.org/wiki/Fidel_Ramos">Fidel Ramos</a> (3.7%), and <a href="http://en.wikipedia.org/wiki/Joseph_Estrada">Joseph Estrada</a> (3.7%). The Philippine economy grew at its fastest pace in three decades in 2007, with real GDP growth exceeding 7%. I`ve been watching all interrogation w/ Sec. Butch Abad what DAP are used for?. They always say that DAP is a reform intervention to speed-up public spending and to boost economic growth. MANILA, Philippines–The Commission on Audit (COA) has found something sour in the P230-million fund from the Disbursement Acceleration Program (DAP) meant for a milk feeding program that had 52 proponents, including Speaker Feliciano Belmonte Jr., lawmakers from the Makabayan bloc and an NGO associated with a sister of President Aquino.<br />
<br />
The milk feeding program was meant to provide 200-milliliter packs of milk to pregnant women, senior citizens and children in day care, pre-school and Grade 1 “pre-identified by the legislators and the ADF for a period of 120 days except for certain legislators who specifically indicated the number of feeding periods in their areas.”<br />
<br />
The ADF is the Assisi Development Foundation led by former Ambassador Howard Q. Dee as chair and Victoria Elisa “Viel” Aquino Dee.<br />
<br />
In its annual audit report on the National Dairy Authority (NDA), the COA cited dubious signatures, faulty monitoring systems, conflicts of interest in the procurement of milk and the failure of the program to live up to the DAP’s goal to be an economic stimulus.<br />
<br />
The NDA is an attached agency of the Department of Agriculture.<br />
<br />
The COA noted the P229.636-million milk feeding program did not contribute to the DAP’s goal of stimulating the economy because only 73 percent or P167.44 million was disbursed in September 2012 to the first and second batches of lawmakers.<br />
<br />
No fund releases were made to the third and fourth batches of lawmakers while the fifth batch was allocated funds outside of the special allocation release order (Saro) and notice of cash allocation (NCA).<br />
<br />
Of the DAP funds channeled to the NDA only half, or P87 million, was spent for 33 projects.<br />
<br />
The COA said that of the 56 projects proposed by 51 legislators, only 28 projects worth P82.165 million were completed; 10 projects worth P30.701 million were ongoing; nine projects worth P30.058 million had yet to be started; three projects worth P10.5 million were not yet obligated; and the remaining six projects worth P21.7 million had no notices of cash allocation yet.<br />

“The ADF’s Hapag-Asa Nutrition Program was not yet started though funds of P2.770 million were already obligated,” COA said.<br />
<br />
The ADF still had P51.648 million from its allocation, which was supposed to have been deployed to milk feeding programs in Regions IV-B, V, VI, VIII, IX, X, XII, XIII and the Autonomous Region in  Muslim Mindanao.<br />
<br />
Budget Secretary Florencio Abad did not reply to the Inquirer’s query as to why the ADF was chosen to be a recipient of the DAP project.<br />
<br />
The Department of Budget and Management (DBM) issued a Saro and NCA on Dec. 22, 2011, (or 11 days after the House of Representatives impeached then Chief Justice Renato Corona) for the release of P229.636 million for the implementation of 57 milk feeding programs of the 52 proponents and the ADF.<br />
<br />
The lawmakers were endorsed by Speaker Belmonte while the ADF’s Hapag-Asa Nutrition program was endorsed by Abad.<br />
<br />
Abad defended his endorsement of the ADF. “They’re a legitimate NGO doing relief and rehab work in Mindanao and calamity-devastated areas. You should examine their track record,” he said in a text message.<br />
<br />
In its reply to the COA, the NDA, led by Administrator Grace J. Senas, blamed the sluggish pace of the milk feeding program on “the non-readiness of some legislators; withdrawal of intent to pursue the projects by the legislators in the 2nd district of Marikina City, 2nd districts of Lanao del Sur and Manila; and the absence of advisories from other legislators.”<br />
<br />
The NDA explained that it had intended to fast-track the project by releasing the funds on a first-come first-served basis, which explained why the DBM issued a blanket authority to avail itself of funds for the lawmakers who were ready but were in the latter batches.<br />
<br />
Questionable signatures<br />
<br />
The COA has recommended that the NDA return all unused DAP funds to the Bureau of Treasury in compliance with the Supreme Court decision last month declaring the DAP unconstitutional.<br />
<br />
In its findings, the COA said there was “no assurance” that  6.7 million packs worth P87.002 million procured by 31 legislators would be “completely delivered” to 104,575 beneficiaries “due to questionable signatures affixed to the documents and incomplete documents (delivery and acceptance receipts, sales invoice and distribution lists) supporting the transactions.”<br />
<br />
“Further scrutiny of the supporting documents showed that the following factors cast doubt as to the completeness of the deliveries made and distribution to beneficiaries: questionable signatures affixed to the supporting documents; incomplete documentation to disbursements totaling P27.045 million; possible conflict of interest between the proponent legislator and the supplier; and existence of pecuniary interest on the part of the NDA milk feeding coordinator, who also represented the supplier of milk packs,” COA said.<br />
<br />
The agency said that “signatures of the legislators’ representatives on the supporting documents appeared to be different when compared with their signatures affixed to the certification issued by the concerned legislators that they are the latter’s authorized representatives.”<br />
<br />
The COA also found out that the persons receiving the goods were not the authorized representatives of the legislators.</div>
